PLEASE READ CAREFULLY

This Shipping Policy (“Policy”) governs all shipments of products sold by AgriFuture LLC (“AgriFuture”).

By placing an order, the purchaser (“Buyer”) agrees to all terms herein. This Policy forms an integral part of the sales agreement.

 

1. SHIPPING TERRITORY RESTRICTION

AgriFuture sells and ships XAG products exclusively within the United States of America.

AgriFuture does not:

  • Ship internationally
  • Arrange the export of products outside the United States
  • Support or facilitate cross-border resale or re-export

The Buyer agrees:

  • Not to export, resell, or transfer products outside the United States without prior written authorization
  • To comply with all applicable U.S. export control laws and regulations

AgriFuture reserves the right to:

  • Refuse or cancel any order suspected of intended export or unauthorized distribution

 

2. ORDER PROCESSING TIME

Orders are processed and dispatched within 1–3 business days from the date of confirmed payment, excluding weekends and public holidays.

Exceptions apply to:

  • Bulk orders — processing time may be extended and will be communicated separately
  • Made-to-order or custom-configured products — lead times will be specified at the time of purchase

AgriFuture will notify the Buyer of any delay beyond the standard processing window.

 

3. SHIPPING TERMS AND RISK TRANSFER

All shipments are made on an FOB Shipping Point basis.

Title and risk transfer to the Buyer upon delivery to the carrier.

AgriFuture bears no responsibility beyond this point.

 

4. SHIPPING METHODS AND CARRIERS

AgriFuture selects the carrier and method at its sole discretion unless otherwise agreed.

Delivery timelines are estimates only and not guaranteed.

AgriFuture is not liable for delays caused by:

  • Carriers
  • Weather
  • Infrastructure issues
  • Regulatory or security-related delays

 

5. FREIGHT AND SHIPPING COSTS

5.1 Spare Parts

  • Free standard shipping may apply for orders above the specified threshold (e.g., $200)

5.2 Equipment

  • Freight shipment required
  • Pricing quoted separately

5.3 Batteries (Regulated Goods)

  • Subject to hazmat handling fees
  • May require specialized carriers

All shipping costs are borne by the Buyer unless otherwise stated.

 

6. DELIVERY AND INSPECTION

The Buyer must inspect shipments immediately upon delivery.

Acceptance of delivery constitutes confirmation that:

  • Shipment condition is acceptable
  • No visible damage exists (unless noted)

Visible damage must be:

  • Recorded on the carrier delivery receipt
  • Reported to the carrier immediately

Failure to comply voids claims.

 

7. SHIPPING DAMAGE AND CLAIMS

All shipping damage is the responsibility of the carrier.

The Buyer must:

  • File claims directly with the carrier
  • Provide supporting documentation

AgriFuture may assist administratively but assumes no liability.

 

8. OUT-OF-BOX DAMAGE (OOB)

All post-delivery damage claims are subject to the Warranty Policy (Section OOB).

Failure to report within the required timeframe results in claim denial.

 

9. FAILED DELIVERY / REFUSED SHIPMENTS

If shipment is refused, undeliverable, or returned due to the Buyer's fault, the Buyer is responsible for:

  • Return freight
  • Storage fees
  • Re-delivery costs
  • Restocking fees (if applicable)

 

10. STORAGE AND DELIVERY DELAYS

If Buyer delays or fails to accept delivery:

  • Risk remains with Buyer
  • Storage fees may apply
  • AgriFuture may invoice additional handling costs

 

11. DELIVERY SITE REQUIREMENTS

Buyer must ensure:

  • Delivery access is available
  • Proper unloading equipment (e.g., forklift) is available
  • Personnel are present

Failure may result in additional charges or failed delivery liability.

 

12. PARTIAL SHIPMENTS

AgriFuture may ship orders in parts. Each shipment is separately invoiced and transfers risk independently.

 

13. NO GUARANTEE OF DELIVERY TIMING

Delivery dates are estimates only. AgriFuture is not liable for delays or consequential damages due to delays.

 

14. LIMITATION OF LIABILITY

AgriFuture is not liable for:

  • Shipping delays
  • Carrier errors
  • Damage after shipment
  • Indirect or consequential damages

 

15. CONTACT AND CLAIMS

All shipping-related inquiries must include:

  • Order number
  • Tracking information
  • Supporting documentation

 

16. GOVERNING LAW

This Policy is governed by the laws of the Commonwealth of Pennsylvania.
